medical examinations of pupils applying for driving licences during their education
In regard to the amendments that were introduced on the examination of secondary school students who will apply for driving licenses during their education, we explain:
1. In accordance with Article 4(1)(a) of Regulation (EC) No Article 75(2a) of the Act of 11 January 2011 on vehicle drivers (Journal of Laws of 2019, item 341, 622, (1287) – medical examinations for a candidate or a high school student (Article 75(1)(7) of the Act) and for a candidate for a vocational qualification course or a student of a vocational course qualification (Article 75(1)(8) above), for which, in the course of the training, the core curriculum provides for preparation for obtaining the skills to drive a motor vehicle or to be qualified to work as a driver – medical certificate, as referred to in the Regulation of the Minister of Health of 29 August 2019 on medical examinations of applicants for driving licenses and drivers (Journal of Laws of 29 August 2019, item 1659) should be issued by a doctor with the following privileges:
(a) to carry out preventive examinations (stamp of the doctor entitled to preventive examinations – so-called full powers);
(b) for examination of drivers, the stamp of the doctor authorised to examine the drivers.
There must therefore be two medical stamps in the document.
2. High school students in grades II or III of schools who have received medical certificates that there are no health contraindications to taking up education before the new rules take effect and for whom, in their education, the core curriculum provides for preparation for obtaining the ability to drive a motor vehicle or to be qualified to work as a driver, the school should issue another referral for examination, with a legal basis – Law on driving vehicles, in order to obtain a decision on the absence or existence of contraindications to driving. This also applies to secondary school students in grades I tested before the above-mentioned regulations take effect.
The assessment is also done by the doctor, who also has ‘double’ powers:
(a) to carry out preventive examinations (stamp of the doctor entitled to preventive examinations – so-called full powers);
(b) for examination of drivers, the stamp of the doctor authorised to examine the drivers.
This assesment shall be valid irrespective of the health establishment in which it was issued.
